Cell phone laws for truck drivers


















The cell phone policy for CDL drivers across the U.S. prohibits commercial motorists from using a hand-held mobile telephone while driving a truck or other commercial motor vehicle. It also prohibits trucking companies from forcing drivers to use a mobile telephone while driving. The penalties can include costly fines and penalties. Accordingly, federal law forbids commercial motor vehicle or CMV drivers of large trucks and buses from texting or talking on cellular telephones while driving in interstate commerce. The law says that such a driver is still “driving” when stopped in traffic or at a stop light, but that it is okay to text or talk on a mobile phone when the CMV is stationary on the side of a highway or Estimated Reading Time: 3 mins.  · The FMCSA regulations allow truckers to use hands-free communication devices, as long as they are located within easy reach of the driver. Michigan adopts regulation for intrastate CMV drivers. Truck drivers must take at least 34 consecutive hours off after driving for a total of 60 hours in seven consecutive days or 70 hours in eight straight days. The next 7/8-day block starts after the 34 off duty hours. As part of these laws for truck drivers, if a driver causes a wreck while violating the federal “hours of service” rules. Penalties can be up to $2, for drivers and up to $11, for employers who allow or require drivers to use a hand-held communications device while driving. Disqualification - Multiple violations of the prohibition of using a hand-held mobile phone while driving a CMV can result in a driver disqualification by FMCSA.
